CONDITIONS OF USE

Thank you for visiting our website. Use of the Ballistic Imports LLC website including visits and placing orders constitutes agreement to our Terms and Conditions. By placing an order you are accepting the Ballistic Imports LLC Terms of Service. We encourage you to review the following information carefully. If you are not in agreement and/or acceptance of these terms, please do not continue use of the website.

AFFIDAVIT OF CUSTOMER

I am not an unlawful user or addicted to any controlled substance.
By selling or delivering ammunition to me, Ballistic Imports LLC is not violating any state or local law or ordinance.
I have never been, and I am not expected to be, convicted in any court of a misdemeanor crime of domestic violence.
I am not under indictment for and have never been convicted in any court of a crime punishable by imprisonment for over one year.
I am not a fugitive from justice.
I am currently not subject to a restraining order of any kind.
I have not been adjudicated as a mental defective and I have not been committed to any mental institution.
I am not an illegal or unlawful alien.
I have never been, and I am not expected to be, discharged from the Armed Forces under dishonorable conditions.
I am not currently less than twenty-one (21) years old.
I have not renounced my U.S. citizenship.
I will use products purchased from Ballistic Imports LLC for lawful purposes only.
If purchasing a firearm, it will be transferred in the name of the person paying for the item via the web site & will not be for another person.

LEGALITY

You agree that any products purchased from Ballistic Imports LLC will be used for any lawful purpose only, and that you are aware of all federal, state, and local laws and regulations concerning the product(s) that you are purchasing, and by purchasing and possessing those items, you will abide by all of those laws and regulations.

You agree that any manufacturing, assembly, or modification of any kind, conducted on firearms or any other product of any kind, using parts, components, accessories, or any other item purchased from Ballistic Imports LLC will be done within legal and regulatory parameters as established by the federal, state, and local authorities. Additionally, you confirm that by manufacturing, assembling, or modifying any product purchased from Ballistic Imports LLC or any other product using products purchased from Ballistic Imports LLC you will abide by all federal, state, and local laws and regulations. You agree that you will abide by all NFA laws and BATFE regulations. Please check with your local authorities and/or with BATFE before doing any modifications or builds. Special federal, state, and/or local licensing, permission, and/or registration may be required for some modifications and builds prior, during, and/or after you commence such activities. You agree not to hold Ballistic Imports LLC liable for any legal consequences resulting from ignorance or deliberate disregard for those federal, state, or local regulations and laws. Ballistic Imports LLC will take all reasonable measures to inform the buyer about legalities concerning each product and not sell and/or ship items where prohibited. However, you agree that the final burden falls with you, the buyer.

LIABILITY

Ballistic Imports LLC does not assume any liability for any harm caused by improper or misuse of products purchased from Ballistic Imports LLC. You agree not to hold Ballistic Imports LLC liable for any such harms caused by improper use, installation, or maintenance performed by you or by any other entity. Ballistic Imports LLC recommends consulting with a professional gunsmith before performing any installation, modification or maintenance.

FIREARM SALES

Ballistic Imports LLC does not ship firearms directly to the end-user once the purchase is completed. All transfers of firearms must go through a federal license holder (FFL). If you do not hold a Federal Firearms License, you must make arrangements with an FFL in your state and jurisdiction of residence to receive and transfer the firearm to you. Reference the How to Buy section for how to complete the firearm(s) transaction. All firearms will be shipped to the premises address indicated on the receiving Federal Firearms License with no exceptions. All required paperwork and background checks must be done by your local FFL holder before transferring the firearms to you. Ballistic Imports LLC does not take any responsibility or liability for any complications arising from the federally mandated background checks or other issues with your FFL dealer. It is the customers responsibility to contact the FFL dealer in advance of the order to arrange any and all transfer details. Ballistic Imports LLC does not contact FFL dealers to arrange transfers or request paperwork.

By placing a firearm order through Ballistic Imports LLC , you confirm that you are of legal age to purchase firearms, that you are legally allowed to purchase firearms in that you have not committed any act or are not under any condition whereas purchasing and possession of firearms by you may be deemed illegal, you are not entering in any kind of activity that may be viewed illegal by any federal, state, or local laws and regulations, and that you are not committing any act of felony (Straw Sale, etc.).

Some of the firearms for sale on our website may be restricted in the state and/or city in which you reside. It is your responsibility to verify the legality of any item being ordered, prior to the placement of that order. If you have any questions with respect to state or local restriction of a firearm you wish to purchase, please inquire with your local FFL prior to placing your order. Ballistic Imports LLC is not responsible for orders placed for illegal items in your area and all returns due to this will be subject to a 20% re stocking fee.

Firearm orders that are canceled prior to shipment due to the legality of owning it will incur a $45.00 cancellation fee. This fee does not pertain to Layaway orders as there are no refunds on Layaway order deposits. Firearms that are returned by your local FFL due to failed background checks or any other complications will incur a 20% restocking fee and original and return shipping fees will be deducted from the refund amount.

Ballistic Imports LLC is not affiliated with any transfer dealers however we do provide a list of dealers we have shipped to in the past. All transfer arrangements are between you the client and your dealer we are not responsible for arranging or negotiating transfers. Ballistic Imports will ship the firearm to the dealer you choose. Any complications that may arise with your FFL transfer dealer after the shipment has left our facility is the customers responsibility since your chose the dealer & Ballistic Imports has no affiliation with the dealer. By placing the order, you agree that you will not attempt to back charge or ask for other compensation on problems experienced with your FFL transfer.

By placing an order for a Firearms and choosing a credit card payment option you acknowledge that the order will ship to your chosen FFL transfer dealer & not your billing address. The FFL will not be the same as your credit card billing address and you waive the right & ability to post a credit card charge back due to any issues or complications with your transfer.

All firearm sales are final, please inspect your firearm @ the FFL dealer before processing the transfer, If there is a problem please leave it at the dealer and contact us via email with the details so we can assist. No returns or exchanges will be processed on any firearm after the transfer. The firearm manufacturer should be contacted directly regarding any technical questions or warranty issues. If you need contact information for the manufacture this is normally located in the owner manual if not please feel free to email Ballistic Imports for contact info.

MAGAZINE RESTRICTIONS

Ballistic Imports LLC will not ship high-capacity magazines to any state or city that has restrictions. For convenience, below is a list of states that have magazine restrictions. Use this as a reference only as state and local laws change frequently. Please check your local & state laws.

It is your responsibility to verify the legality of any magazine being ordered, prior to the placement of that order. If you have any questions with respect to state or local restriction of a magazine you wish to purchase, please inquire with your local FFL prior to placing your order.

AMMUNITION SALES & RESTRICTIONS

By placing an order for ammunition through Ballistic Imports LLC, you confirm that you are of legal age to purchase ammunition, that you are legally allowed to purchase ammunition in that you have not committed any act or are not under any condition whereas purchasing and possession of ammunition by you may be deemed illegal, you are not entering in any kind of activity that may be viewed illegal by any federal, state, or local laws and regulations, and that you are not committing any act of felony.

It is your responsibility to verify the legality of any ammunition being ordered, prior to the placement of that order. If you have any questions with respect to state or local restriction of a magazine you wish to purchase, please inquire with your local FFL prior to placing your order.

Ballistic Imports LLC will not ship ammunition to the State of California, Massachusetts, New York, Chicago (IL), Alaska or Hawaii.

Ammunition must ship via Ground, orders that request shipments to PO Boxes will be cancelled.

ALL Ammunition shipments will be sent Signature Required to verify delivery and limit theft. Please make sure you can sign for the delivery.

REBATES AND COUPON OFFERS

From time to time, Ballistic Imports LLC offers its clients special offers and discount codes to be used in conjunction with this website. These offers are frequently disseminated via this website and through email to those who have registered for our email database. We encourage our clients to redeem these special offers, but we respectfully ask that you not exploit them. Ballistic Imports LLC, at our sole discretion, will determine if all purchasing criteria has been met to qualify for stated discount or free product. If you successfully circumvent the software safeguards of this website in order to receive several free products with your order, then we will (at our sole discretion) remove any extraneous free product from your order or cancel the order in its entirety. You will be informed of any order changes via the phone number or email address listed with your order.

PROHIBITED SHIPPING ADDRESSES

Ballistic Imports LLC does not ship to the following:

International Addresses
US Protectorates (Puerto Rico, Virgin Islands, etc)

PAYMENT

All orders placed online must be paid in full prior to shipping, Payment details are outlined in the How to Buy section.

TERMS OF SALE

Placing an order through Ballistic Imports LLC does not constitute a sale nor does it entitle you to the products ordered through Ballistic Imports LLC. All above mentioned conditions must be met before Ballistic Imports LLC finalizes the sale of merchandise. Ballistic Imports LLC may require additional documents (licenses, permits, etc.) before completing the sale. If your order includes a firearm, Ballistic Imports LLC will require your transferring FFL holder have a copy of their license on file with Ballistic Imports LLC before finalizing the order. All payment requirements must be met before a sale can be finalized and merchandise can be shipped out. By placing an order with Ballistic Imports LLC you are agreeing to our Terms and Conditions.

ORDER PROCESS AND SHIPMENT

Most orders are usually processed and shipped in 1 -2 business days. Firearm & regulated items will not ship until the required information is received and verified by Ballistic Imports LLC. If your order contains both a firearm and accessories, the accessories will ship to the FFL dealer with the firearm we do not offer split shipments on the same order.

Ballistic Imports LLC will cancel any order that has a different recipient name and delivery address (firearms excluded), no exceptions.

Certain high value shipments $300.00 or more will require a signature to guarantee delivery this is also required for Optics, Body Armor, Parts Kits , Ammo and Firearms Uppers. It is your responsibility to be able to sign for the shipment any returns because of a lack of signature will be subject to a 20% re stocking fee.

Once the order has shipped, an email will be sent to you with tracking information.

Any change to the delivery method, delivery options, address change or correction, or any other modification that will require carrier’s intervention, will incur a $20.00 surcharge per incident or request and will need to be paid in advance prior to initiating the change by Ballistic Imports LLC. Some change request may not be able to be fulfilled.

Ballistic Imports LLC ships most orders from our main warehouse but may also choose to ship orders from one our fulfillment warehouses.

We do not offer combined shipping or multiple orders.

We do not offer guaranteed delivery time refunds from the carriers.

GUARANTEE

All products sold by Ballistic Imports LLC are guaranteed to be new and free of manufacturing defects and are covered by the manufacture warranties unless otherwise stated. All returns would be direct with the original manufacture or importer. Ballistic Imports does not offer warranty repair or replacement part. We will be glad to provide you with contact info for the manufacturer.

LAYAWAY TERMS

All layaway orders must be paid for via Credit Card NO money order or checks.
25% must be put down at time of purchase and the balance is due within 45 days, 45 days is the max time frame please do not ask to extend the time period, there are NO Exceptions.
It is the customers responsibility to log into their account & make the payments we will not contact you with reminder notices etc. There is No Grace period 45 days is the max time frame so please do not claim you did not know.
Orders will not ship until final payment has been made on the layaway.
We do not offer changes or additions to the original layaway NO exceptions.
Overdue layaway's will be canceled on the 46 th day, There will be no refund of original deposit, Just to repeat this a second time original deposits are non-refundable. There are no Exceptions.
It is the customers responsibility to make the final payment, we will not contact you this is your responsibility.
The layaway will lock in the current price and or promo offered for the item at the time of the initial payment, if the price goes up you are locked in if the price goes down or other you are locked into the original order and will not be eligible for changes to the layaway. Prices are subject to change. If a promotion is offered After your layaway is placed your order is not eligible for the promotion. Again, you are locking down the deal the day the layaway is initially placed. If the price goes up on a item we do not contact customers asking for more money.
Canceled layaways will forfeit ANY deposits made. There will be no refunds once the layaway order has been placed.
The Billing address on the Original Layaway order must match the card or cards used for subsequent payments. You will not be able to change the name on the card or Billing address for payments after the initial order is placed.
We do appreciate previous order history and our long-term customer relationships, but this does not allow modification of terms by existing customers.
You may not apply a deposit to another order or ask for a credit or to alter the terms because you feel that we should this one time.
Please do not feel that you can modify the terms after the fact or make up or change the layaway terms after the fact, our terms are very clear you are placing a deposit on a item that will be pulled and held for you. You are responsible for making the final payment within the terms of the agreement. Other circumstances outside of the terms are not a part of the agreement and we will not alter, modify or take any special considerations. The Layaway Terms are exactly as we have listed.
By placing a layaway, you are legally agreeing to the terms and conditions of the Ballistic Imports LLC Layaway program.

REFUNDS AND EXCHANGES

Any and all request for refunds or returns must be done in writing via email so we can document the time and date of the request. No return or refund request can be done via phone or voice mail. Please send us all of your contact info and a brief description of the problem or request so we may assist. Email support@ballisticimport.com

We offer a 10-day return period from the day the merchandise is delivered this does not include Firearms, Body Armor, Ammo or any used items. If you wish to return an item, please contact us at support@ballisticimport.com with details of the product and the defect. Upon review Ballistic Imports LLC will provide return shipping information, including an RA number. Returned items must be in new, original condition and in original factory packaging. We cannot accept returns on items that have been opened, installed or used. Shipping charges for all returns must be prepaid by you. Ballistic Imports LLC will not be responsible for any loss or damage to the package during shipment. We do not guarantee that we will receive your returned item and suggest insuring and getting tracking information when shipping. Shipping and handling charges are not refundable.

Upon receipt of the returned product, we will fully examine & validate the return. Once approved you will be refunded, using the original method of payment. Refunds will not include original shipping charges shown on the packaging slip or invoice. Refunds may take 5 -7 days to process. You will see a refund confirmation emailed to you from the credit card processor once completed. Please Note: Depending on the speed of the various banks involved it may take 2-4 business days for the refund to post to your account.

Items that are returned and non-defective may be subject to a 20% restocking fee against the original purchase price. Items must be in original, unopened factory packaging.

Before we can process a refund we must have your return in hand and inspected. No refunds or exchanges before we receive the return . Refunds may take 5 -7 days to process after receipt of your package.

Items found to be defective or broken should be addressed with the manufacturer of that item as they are covered under their warranty.

There is no warranty on used products.

New firearms are covered by the manufacturer’s warranty and should be returned directly to the manufacturer for repair. Please feel free to contact our office so we can be aware of the problem and help you with the correct contact info for the manufacturer etc.

Ballistic Imports LLC neither warranty's or guarantees any weapon or item purchased. The original manufacturer warranty's the item. We will be happy to be of any assistance possible with your warranty claim. You may not repair a item covered under warranty and ask for Ballistic Imports to cover unauthorized repairs. Any and all repairs must be completed by the original factory unless otherwise agreed upon in writing from Ballistic Imports.

Any returned items must be unfired or unused and in the exact condition in which it was shipped to you or your dealer. This includes boxes and accessories. Returns must first be authorized by Ballistic Imports any items sent back without RMA will be refused. Any firearm return must be double boxed and must include a photo copy of the front and rear of your driver’s license. Any gun that is sent back without the RMA# and Photo ID will be turned over to the ATF. All returns may be subject to a 20% restocking fee. There are no returns on items 10 days after delivery from FedEx.

Ballistic Imports LLC is a licensed business in the State of Texas. Ballistic Imports LLC complies with all applicable State and Federal laws. All products and persons associated with Ballistic Imports LLC comply with State and Federal restrictions.

By using, viewing or accessing www.ballisticimport.com, you agree that the laws of the state of Texas, without regard to principles of conflict of laws will govern these Terms and Conditions and any dispute of any sort that might arise between you and Ballistic Imports LLC.

By using, viewing or accessing the Ballistic Imports LLC, you agree that: (i) our website shall be deemed solely based in Texas State; and (ii) our website is a passive website that does not give rise to personal jurisdiction over Ballistic Imports LLC, either specific or general, in jurisdictions other than Texas State. These Terms and Conditions shall be governed by the internal substantive laws of the State of Texas, without respect to its conflict of laws principles. Venue for any legal action concerning any claim or dispute between you and Ballistic Imports LLC that arises in whole or in part from our website, the purchase of any Ballistic Imports LLC products or any other transaction between you and Ballistic Imports LLC shall lie exclusively in Worcester County, Texas, and by using, viewing, purchasing and/or accessing the Ballistic Imports LLC website you expressly consent to jurisdiction and venue in such court.

These Terms of Use, together with the Ballistic Imports LLC Privacy Policy and any other legal notices published by Ballistic Imports LLC on our website, shall constitute the entire agreement between you and Ballistic Imports LLC concerning our website. If any provision of these Terms of Use or the Ballistic Imports LLC Privacy Policy is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions therein, which shall remain in full force and effect. No waiver of any term of this these Terms of Use or the Ballistic Imports LLC Privacy Policy shall be deemed a further or continuing waiver of such term or any other term, and Ballistic Imports LLC; s failure to assert any right or provision under these Terms and Conditions or the Ballistic Imports LLC Privacy Policy shall not constitute a waiver of such right or provision. Ballistic Imports LLC reserves the right to amend these Terms and Conditions or the Ballistic Imports LLC Privacy Policy at any time and without notice, and it is your responsibility to review these Terms and Conditions or the Ballistic Imports LLC Privacy Policy for any changes. Your use of our website following any amendment of these Terms and Conditions will signify your assent to and acceptance of its revised terms. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of our website or related services must be filed within one (1) year after such claim or cause of action arose or shall be forever barred.

CANCELATIONS

We invest time and money to prepare every order that is placed on our site even before the order ships. Our business is not set up to change orders easily and need our customers to be sure of their order before placing it via the web site. If you place a order and want to change it the only option is to cancel the order. Any Canceled orders will be subject to a $45.00 cancellation fee. We immediately start to process the paperwork for orders so we cannot guarantee that the order will be able to be stopped before shipping out. ANY orders cancellations must be submitted via email to support@ballisticimport.com, There are no phone cancellations. Please include your order number, name, and reason for the cancellation & in the Subject title mention Cancellation. We will do our best to accommodate your request but there is NO guarantee of this since we are shipping hundreds of orders per day from multiple warehouses, and it may take up to 24 hours for a cancellation once emailed. If a order is shipped out and you still want to cancel you will be responsible for the return ship and 20% restocking fees.

Refunds on canceled orders are processed at the end of our business week every Sunday. If you cancel on a Monday, you will not see the refund processed until the following Sunday. You will receive a email refund confirmation once processed. Please Note, after the refund is processed the banks may take 1 -4 business days to transfer funds.

Orders that have shipped out and are then changed will be subject to shipping fees both ways and a 20% restocking fee

By placing an order, you are agreeing to accept the Terms & Conditions of the Ballistic Imports Return Policy.

ACCEPTANCE OF TERMS AND CONDITIONS

You affirm that you are: i) at least 18 years of age; ii) an emancipated minor; or iii) possess legal parental or guardian consent and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Service and the Ballistic Imports LLC Privacy Policy, and to abide by and comply with such terms, conditions and obligations.

ASSIGNMENT

These Terms and Conditions, and any rights and licenses granted here under, may not be transferred or assigned by you, but may be assigned only by Ballistic Imports LLC without restriction.

CHANGES IN POLICY

Ballistic Imports LLC reserves the right to modify, alter, delete and update these policies at any time we see fit. Such alterations do not nullify our rights if infringements or breaches occurred under a previous version of these conditions. You agree that Ballistic Imports LLC shall not be liable to you or to any third party for any modification, suspension or discontinuance of any service.
